What is PorOrBor? Let's find the answer to clear up any doubts. "PorOrBor" is Compulsory Motor Insurance (Compulsory Motor Insurance Act)which the law requires every vehicle to have insurance under the Compulsory Motor Insurance Act B.E. 2535 (1992) which mandates that all types of land vehicles registered with the Department of Land Transport must have this type of insuranceby providing coverage specifically for loss of life and bodily injury to third parties who are victims of accidents involving any type of vehicle regardless of whether the individuals affected by those accidents are at fault or not. The law only provides coverage for the counterparty and the insured in the event of a vehicle accident! according to the coverage limits specified in the policy schedule of that particular vehiclein the form of compensation and medical expenses as stipulated by law.
What if I don't buy PorOrBor?
The answer is...no! Because the PorOrBor certificate is required for vehicle registration renewal or annual vehicle tax renewal, as mandated by law for all vehicles. It can be renewed up to 3 months in advance. If our vehicle does not have PorOrBor, there is a fine of not exceeding 10,000 Baht. (Known as PorOrBor - used to show when renewing annual vehicle tax)
What does PorOrBor cover us for?
PorOrBor only covers damages to individuals! In simple terms, it covers "people" not "vehicles". The initial coverage under the PorOrBor is as follows:
-Medical expenses for injuries and funeral expenses for death, without waiting for fault to be proven. The company will compensate the victim/legal heir of the victim within 7 days from the date the company receives the claim for such damages, which is called “Initial Compensation”.
-In case of permanent disability: (any one condition) 35,000 Baht per person -In case of injury: Medical expenses will be compensated according to Item 1, and subsequent permanent disability according to Item 2, totaling not exceeding 65,000 Baht per person
-In case of death: 35,000 Baht per person -In case of death after medical treatment and necessary medical expenses as actually paid according to Item 1, totaling not exceeding 65,000 Baht per person
-In case of injury but not leading to loss of organ or permanent disability: Not exceeding 80,000 Baht per person
-In case of loss of organ: 200,000-300,000 Baht per person
-In case of death / permanent disability: 300,000 Baht per person
-Daily compensation (inpatient): 200 Baht per day, for a total of not exceeding 20 days. This is additional damage compensation beyond the aforementioned coverage.
What happens if 2 or more vehicles cause damage?
-In cases where 2 or more vehicles cause damage (collision), resulting in injury or death to occupants, whether drivers or passengers, the insurance company of each vehicle must pay initial compensation to the victim who was in the vehicle insured by that company. However, if the victim is a third party not in any of the vehicles, the companies must jointly pay initial compensation to the victim, equally distributed.
Period for claiming rights, etc.
The victim must request initial compensation within 180 days from the date the damage occurred.
How to claim, with the following evidence: -In case of injury:
1.1 Receipt from a hospital or medical facility, or an invoice for medical treatment.
1.2 Copy of national ID card, or copy of alien identification card, or copy of passport, or any other official document that can prove the person named in the document is the victim.
-In case of permanent disability: In addition to submitting evidence according to Items 1.1 and 1.2, a medical certificate or doctor's opinion or any other evidence indicating that the victim is permanently disabled must be submitted, along with a copy of the police report or other evidence showing that the person suffered damage from a vehicle accident. -In case of death:
2.1 Copy of death certificate.
2.2 Copy of police report.
2.3 Copy of national ID card, or copy of alien identification card, or copy of passport, or any other official document that can prove the person named in the document is the victim.
***The Victims Compensation Fund will not be responsible if:
1. The vehicle that caused damage to the victim did not have insurance as required by law, and the vehicle owner does not pay initial compensation (for injury, actual treatment costs not exceeding 30,000 Baht; for death, 35,000 Baht).
2. The vehicle that caused the damage was not in the possession of the owner at the time of the incident because it was embezzled, defrauded, extorted, stolen, robbed, or plundered, and a complaint has already been filed with the police investigator. 3. The vehicle has no identified owner and no insurance for damages as required by law.
4. The driver of the vehicle fled, or it cannot be determined which vehicle caused the damage.
5. The company does not pay initial compensation to the victim or pays incomplete initial compensation to the victim.
6. The vehicle that caused the damage is a vehicle exempted by law.
If an uninsured vehicle causes damage to a victim:
The law mandates that vehicle owners must have insurance under the Compulsory Motor Insurance Act B.E. 2535 (1992). If the vehicle owner violates this by not having insurance and that vehicle causes damage to a victim, the vehicle owner is responsible for that damage.
-If the victim is injured, the vehicle owner must pay medical expenses, or if death occurs, be responsible for funeral expenses, at least not less than the amount specified by law (for injury, actual treatment costs not exceeding 30,000 Baht; for death, 35,000 Baht).
If less than this amount is paid, the victim or their legal heir can still claim the remaining amount from the Victims Compensation Fund. Once the Victims Compensation Fund has paid, the law requires the registrar under the Compulsory Motor Insurance Act B.E. 2535 (1992) to demand reimbursement from the vehicle owner for the amount paid, plus an additional twenty percent of the initial compensation amount paid from the Victims Compensation Fund, to be contributed separately within 7 days from the date of receiving the registrar's order. ***Now that you know both the benefits and penalties, don't forget!
