Inter-Media Consultant Co., Ltd. (“the Company”) recognizes the importance of privacy rights and the Company's responsibility regarding the collection, use, and disclosure of your personal data. The Company considers the trust and confidence you place in us to be one of the most important values. Therefore, the Company is committed to ensuring that the collection, use, and disclosure of your personal data are conducted properly, appropriately, and transparently, and that your personal data is protected in accordance with the Personal Data Protection Act B.E. 2562 (2019) as follows:
Section 1. Personal Data
“Personal Data” means information that can identify an individual such as first name, last name, national identification number, telephone number, email, address, date of birth, occupation, photographs, financial information, health information, biometric data, recorded voice, and technical usage data related to your preferences, etc.
Section 2. Respect for Privacy Rights
(1) The Company respects and values personal data rights and personal data protection of you as customers, partners, contractual parties, employees, and stakeholders of the Company.
(2) Your personal data that the Company receives, such as name, age, address, telephone number, national ID number, financial information, income, source of income, tax information, bank account numbers, etc., which can identify you as an individual and are complete, accurate, current, and of good quality, will only be used in accordance with the Company’s operational purposes. The Company will implement strict security measures to maintain security and prevent unauthorized use of your personal data without your prior consent.
(3) The Company recognizes the importance of maintaining the security of personal data and therefore has established appropriate security measures in accordance with the confidentiality of personal data as specified in the Company’s information technology security policies and practices.
Section 3. Purpose of Collecting or Using Personal Data
(1) The Company collects your personal data in order to perform contractual obligations between the Company and you, including conducting operations in accordance with the Company’s business objectives and improving the quality and efficiency of services provided to you. The Company will retain such data only for the period necessary for these purposes.
(2) If there are changes to the purposes of collecting personal data in the future, the Company will notify you and request your consent, and will record such amendments as evidence.
(3) In cases where the Company collects, stores, uses, or discloses personal data for purposes other than those stated, you have the right to choose whether to allow or not allow such collection, storage, use, or disclosure of your personal data.
(4) For the purpose of analyzing and monitoring website usage and for auditing purposes in case of system issues, the Company automatically collects website access logs (Log Files), which include at least the following information:
(4.1) IP Address
(4.2) Browser type
In addition, the Company may use services from external providers that maintain website access logs in accordance with legal requirements when the Company uses third-party website service providers.
(5) The Company will not act in any manner inconsistent with the stated purposes of data collection unless:
(5.1) A new purpose has been notified to you and your consent has been obtained
(5.2) Required by law
Section 4. Collection of Personal Data
(1) In collecting and storing your personal data, the Company will use lawful and fair methods and will collect and store personal data only to the extent necessary for contractual obligations or services through electronic or other methods under the Company’s objectives.
(2) The Company will obtain your consent before collecting personal data, except in the following cases:
(2.1) For achieving objectives related to historical records or archives for public interest, education, research, or statistical purposes with appropriate protection measures in place
(2.2) Necessary to prevent or suppress danger to a person's life, body, or health
(2.3) Necessary for the performance of a contract to which the data subject is a party or for taking steps at the request of the data subject prior to entering into such a contract
(2.4) Necessary for the performance of tasks carried out in the public interest by the data controller or in exercising official authority vested in the data controller
(2.5) Necessary for the legitimate interests of the Company or other persons or legal entities other than the Company
(2.6) Compliance with laws such as the Personal Data Protection Act, Life Insurance Act, Office of Insurance Commission regulations, Anti-Money Laundering Act, Counter-Terrorism Financing Act, Civil and Commercial Code, Civil Procedure Code, Criminal Procedure Code, etc.
(2.7) For your benefit when obtaining consent cannot be done at that time
Section 5. Use or Disclosure of Personal Data
(1) The Company will keep your personal data confidential except where disclosure is permitted by law or where such disclosure is necessary to fulfill the purposes of a contract between the Company and you. The Company may provide such personal data to relevant parties.
(2) The Company will ensure that its personnel do not disclose, display, or otherwise make your personal data known beyond the stated purposes or to external parties, except in cases specified under Section 4 (2.1) to (2.7).
Section 6. Rights of Data Subjects
(1) If you wish to know about your personal data, you may submit a request in accordance with the procedures set by the Company. Once the Company receives such request, it will promptly inform you of the existence or details of such personal data within a reasonable period.
(2) If you believe that any personal data relating to you is incorrect, you may notify the Company to correct, amend, or delete such data. The Company will record such objections or corrections as evidence.
(3) You have the right to verify the existence and characteristics of personal data, the purposes of its use, and the Company’s operating location. You also have the following rights:
(3.1) Request a copy or certified copy of your personal data
(3.2) Request correction or amendment of your personal data to ensure accuracy and completeness
(3.3) Request suspension of the use or disclosure of your personal data
(3.4) Request deletion or destruction of your personal data
(3.5) Request disclosure of how your personal data was obtained if it was collected without your consent
The Company will act upon your request through the designated rights request channels. However, the Company reserves the right not to comply with such requests where appropriate and as permitted by applicable laws.
Section 7. Policy Amendments
The Company may update this policy from time to time to ensure compliance with the Personal Data Protection Act and to align with technological changes as well as the Company’s services and operations. The Company will clearly announce any changes before they take effect or may notify data subjects directly. You may review the Company’s personal data protection policies and practices on the Company’s website.
Section 8. Data Protection Officer
(1) The Company has appointed a Data Protection Officer (DPO) to oversee the Company’s operations related to the collection, use, and disclosure of personal data in compliance with the Personal Data Protection Act B.E. 2562 and other relevant laws. The Company has also established regulations and orders for relevant personnel to follow to ensure that operations related to personal data protection policies are conducted properly.
(2) Details regarding the collection, use, and disclosure of personal data and the exercise of data subject rights shall be in accordance with the personal data protection practices announced by the Company.
